It isn't, per the 14th Amendment. The idea that only things that existed when the amendment was ratified are protected would be something I could get behind if we applied the same logic to the 2nd Amendment, but we don't and for good reason.

Picrel. 4th Amendment has been fucked for a long time. It's not a matter of if but when something gets in front of SCOTUS to gut internet privacy protections (and, really, privacy protections in general).
