If Jay Clayton honestly believed that this entire time in the time Ripple's been operating like this, actively and openly seeking clarity for their asset, and meeting with Jay Clayton himself on occasion, we'd have seen a lawsuit by now. There's absolutely political motivations behind this lawsuit that are intended to ripple through the entire crypto space long term.

Whether think XRP is a scam or not, you DON'T want Ripple to lose this. You have nothing to gain and much to lose from such an outcome. This WILL set a nasty precedent for current and future projects if the SEC comes out on top.
